Terms of Use
The short version
- Adults create the account and are responsible for their family's use. Kids play under a parent's account and supervision.
- Plans start with a 14-day free trial, then renew automatically until you cancel â which you can do any time from My Family.
- Be kind, play fair, don't share your sign-in, and only upload photos you have the right to use.
- Play Credits are game time, not money. They have no cash value and can't be transferred or refunded.
- We work hard to keep the site up and safe, but it's provided "as is" â see sections 10â12.
1. Accepting these terms
By creating an account, starting a trial or subscription, or using www.family-arcade.com (the "Service"), you agree to these Terms of Use and to our Privacy Policy, which explains how we handle your family's information. If you don't agree, please don't use the Service. We may update these terms (section 15); the date at the top tells you when they last changed.
2. Who can use Family Arcade
You must be at least 18 and the parent or legal guardian of any child you add. Children use the Service only through accounts you create and manage, and you are responsible for supervising their use, for the settings you choose (including online play permissions), and for everything that happens under your family's accounts. Each plan includes a set number of parent and child accounts; adding more children is an optional paid add-on.
3. Your account
Keep your password private and choose kid usernames and passwords sensibly. Tell us right away if you think an account has been used without permission. You may not share a family account with people outside your household, create accounts for children you are not responsible for, or use someone else's identity. Admin approval or a successful payment is what activates a family; we may decline or suspend accounts that break these terms.
4. Subscriptions, trials and billing
Trial. New families get a 14-day free trial. A payment card is required to start it; nothing is charged during the trial, and we email a reminder three days before the first charge. Cancel before the trial ends and you pay nothing. One trial per family.
Renewal. After the trial, your plan renews automatically â monthly or yearly, at the price shown when you subscribed â until you cancel. Charges are processed by Stripe; we never see your card number.
Cancelling. Cancel any time from My Family â Manage billing. You keep access until the end of the period you've paid for, and you won't be charged again. We don't give refunds for partial periods, except where the law requires it or where we've made a mistake â in which case use our contact form (choose "Billing, plans or refunds") and we'll put it right.
Changes. You can switch plans or add children at any time; differences are prorated by Stripe. If we change prices, we'll email you at least 30 days before the new price applies to your renewal, and you can cancel before then.
Failed payments. If a payment fails, we'll ask you to update your card and allow a short grace period; after that the family's access pauses until payment succeeds.
Hero-picture packs are one-time purchases added to your family's allowance and are not refundable once used.
5. Play Credits and game time
Play Credits are earned by learning and spent as game time. They are a feature of the Service, not currency: they have no cash value, can't be bought, sold, transferred between families or exchanged for money, and expire if an account is closed. We may adjust how credits are earned or spent to keep the game fair; we'll avoid taking away credits already earned.
6. Acceptable use
Use the Service as a family learning-and-games site and nothing else. In particular, you agree not to: harass, bully or impersonate other players; try to contact other families' children outside what the Service allows; cheat, use bots, scripts or automated tools, or tamper with scores, credits or limits; probe, scan or attack the Service or try to access accounts or data that aren't yours; copy, scrape, resell or redistribute the Service or its content; upload anything unlawful, hateful, sexual or that infringes someone's rights; or use the Service in a way that breaks any law. We may remove content and suspend or close accounts that break these rules, without refund for the current period.
7. Photos and content you provide
You may upload photos to create cartoon heroes, and family members may submit feedback, suggestions and messages. You confirm that you have the right to upload each photo â it's of you, your child, or someone whose parent has given permission â and that it doesn't infringe anyone's rights. Photos are processed and discarded as described in our Privacy Policy; the resulting cartoon is yours to use in the Service. You give us a non-exclusive licence to store, display and process the cartoons and other content you provide for the purpose of running the Service, and to use suggestions you send us to improve it, without payment or credit. You can delete heroes at any time, and we remove them when a family is deleted.
8. Online play and other families
Online matches are family-only unless a parent widens a child's setting. When you allow play with other families, you accept that your child's display name, chosen character and family name will be visible to those players. There is no chat. If another player behaves badly, report it and we'll investigate.
9. Our content and your licence
The Service â its games, Learning Quest worlds and questions, lessons, artwork, characters (including Karter and Khloe), code and design â belongs to Childs LLC or its licensors and is protected by copyright and other laws. We grant your family a personal, non-transferable, non-exclusive licence to use it through the Service while your account is active. Learning content is for your family's education, not for redistribution, classroom resale or training other systems. "Family Arcade" and our logos are our marks; please don't use them without permission.
10. Availability and changes to the Service
We add, change and occasionally retire games and features, and we may need to take the Service offline for maintenance or because of problems outside our control (hosting, payment or AI providers, for example). We'll try to give notice of significant changes and will not charge for periods when the Service is unavailable for an extended time through our fault â contact us and we'll sort out a credit.
11. Disclaimers
Family Arcade is an educational entertainment product. It supplements, and doesn't replace, school, teachers or your own judgement. Questions and lessons are checked carefully but may contain errors; AI-generated practice questions and cartoon images may occasionally be imperfect â tell us and we'll fix them. The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent the law allows.
12. Limitation of liability
To the fullest extent permitted by law, Childs LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms limits liability that can't be limited by law, including for fraud or for death or personal injury caused by negligence.
13. Indemnity
You agree to cover us against claims, losses and reasonable costs that arise from your family's breach of these terms, from content you upload, or from your misuse of the Service.
14. Ending the agreement
You can close your family account at any time by cancelling your plan and asking us to delete the family's data. We may suspend or close accounts that break these terms, are used fraudulently, or after an extended period without payment, and we may discontinue the Service with at least 30 days' notice (refunding any prepaid period beyond that date). Sections 5, 7, 9 and 11â16 survive the end of this agreement.
15. Changes to these terms
When we change these terms we'll update the date above and, for changes that matter to you (pricing, billing, children's privacy, your rights), email parents at least 30 days before they take effect. Continuing to use the Service after that date means you accept the new terms; if you don't, cancel before they apply.
16. Governing law and disputes
These terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-law rules. If you have a problem, please contact us first â most issues are solved in a quick conversation. Any dispute that can't be resolved informally will be brought in the state or federal courts located in Miami-Dade County, Florida, and you and we consent to their jurisdiction; nothing here prevents you from using consumer-protection rights available where you live, including small-claims court.
